Two: that highway patrolman is a pro and KNOWS the law.  He knows exactly how to frame the situation to get to search anyone he wants.  It isn't right, but that man knows the loopholes.

So since I'm bar-prepping and issue spotting, I thought I'd circle back and explain the Halo Bender's video.

So at first blush it seems pretty bogus right?  You can't search a dude for "lingering in the left lane too long"  I'm not even sure that what they pulled him over for is any sort of violation, but lets assume it is.  Now typically, under Terry v. Ohio, a frisk like the one he did wouldn't stand. Basically under Terry, a cop can frisk someone without the normal amount of probable cause if there is some indication that the cop's safety might be at risk if he doesn't frisk.  Since Terry, the court has been scaling back the safety risk frisk, requiring that the officer be able to show some reasonable suspicion that the person was armed, or was doing something else violent or something.  In a recent case, a cop stopped a couple guys in a high crime area but had no reason to believe that they were doing anything wrong.  Tensions were high in the neighborhood because of a string of gang shootings.  So the cop stops this guy, frisks him for his safety, and finds a gun.  The gun is inadmissible because he had no reasonable suspicion the guy was committing a crime. 

So back to stopping a guy for lingering in the left lane, frisking him for "safety" and then finding some paraphernalia and a little pot.  The cop tricked him into consenting to search the van, so basically once you say 'yeah sure search the van' they can do it and you've got no defense.  But when the cop asked the same question about checking his pockets, he was silent.  silence, in the context of a request to search, doesn't = assent.  Now, since it was videotaped, they could probably argue that he lifted his arms or allowed them to search by his body language but that is pretty weak.  With a good lawyer, that guy could've gotten the charges dropped if the case were today.  In the 90's, though, Terry was still pretty strong and in Utah I doubt the trial court judge would've chortled if you started raising constitutional grounds for a $300 fine

I went to some Sleazefests back in the day. Chapel Hill is a famously anti-dance scene, but Sleazefest was one of the few shows you could count on people letting go.
